Liability waiver
Complete client intake formThis is proposed wording, not an active agreement or legal advice. An Ontario lawyer should confirm the studio’s legal operator, the parties covered by the release and the final terms before it is used.
Reading this page does not record consent, a signature or acceptance of a waiver.
The You Studio is powered by TeamYou HQ. This draft addresses participation in You Studio Pilates classes and use of studio amenities. It does not replace any separate agreement for TeamYou HQ gym activities.
01 — Participation and personal choice
Taking part in Pilates is voluntary. Mat Pilates uses body-weight movement, Reformer Pilates uses spring-based equipment, and Fusion combines both styles. Participants should choose an appropriate level of effort, request modifications when needed and stop any activity that feels unsafe.
02 — Understanding the risks
Exercise can involve soreness, strains, sprains, loss of balance, falls, dizziness and cardiovascular stress. Reformer springs, straps and moving carriages can create additional risks, including pinching or injury from incorrect equipment use. Serious injury is possible, even when reasonable precautions are taken. Not every risk can be predicted or eliminated.
03 — Health and readiness
Participants should consider their health, fitness and any limitations before attending. Seek advice from a qualified healthcare professional if pregnancy, an injury, a recent procedure, a medical condition or medication may affect safe participation. Share relevant limitations with the instructor before class and ask for suitable alternatives. Pilates instruction is not medical diagnosis, treatment or rehabilitation advice.
04 — Heated classes and sauna use
Mat, Reformer and Fusion classes may be offered heated or at normal room temperature. Heated exercise and sauna use can increase the risk of dehydration, overheating, faintness and heat-related illness. Participants should assess their tolerance for heat, hydrate appropriately and leave the heated area if they feel unwell. Seek medical guidance where heat exposure may be unsuitable.
05 — Equipment and shared-space safety
Follow instructor guidance and posted safety directions. Ask for help before adjusting unfamiliar equipment and report damage or hazards promptly. Move carefully around reformers and through shower, sauna and lounge areas, where wet surfaces or obstacles may cause slips or falls. Do not continue exercising with chest pain, unusual shortness of breath, dizziness or other concerning symptoms; notify staff and seek appropriate help.
06 — Voluntary assumption of risk
Under this proposed waiver, a participant acknowledges the risks described above and chooses to participate despite them. That acknowledgment includes risks inherent in exercise, heat exposure, equipment use and movement through shared studio spaces, whether a particular risk is anticipated or not. Nothing here waives a right that applicable law does not allow to be waived.
07 — Proposed release of liability
To the extent permitted by applicable law, the proposed agreement would release the studio’s confirmed legal operator and its owners, employees, instructors and contractors from claims for personal injury, death or property loss arising from participation in You Studio classes or use of its amenities, including claims alleging ordinary negligence in instruction, supervision or equipment maintenance.
The proposed release would not cover gross negligence, intentional wrongdoing or liability that cannot legally be excluded. The legal operator’s full name and the precise scope of this clause must be confirmed by legal counsel before anyone is asked to sign.
08 — Personal belongings and consideration for others
Keep belongings clear of equipment, walkways and wet areas, and take reasonable care of valuables. Respect other participants and staff, avoid unsafe conduct and promptly raise safety concerns. These precautions do not remove any responsibility the studio may have under applicable law.
09 — Separate studio policies
This draft does not establish a minimum participation age, cancellation fees, refund rules, membership renewal terms or payment arrangements. Those matters must be confirmed separately in the studio’s approved policies and purchase terms. Any participation requirements for minors also require separate confirmation and legal review.
10 — Review and acknowledgment
Before signing a finalized waiver, participants should read the full agreement, ask questions and understand that a release may limit their ability to bring a legal claim. Signing must be a separate, informed step; visiting this website alone is not agreement to these proposed terms. The intended governing law is Ontario law and applicable Canadian federal law, subject to legal review.
